Sam Lutfi says a restraining order banning him from Britney Spears hasn’t been extended.

In a statement released Friday, he said reports that he has been barred from seeing the singer until April 16 “have not been proven to date.”

He said he never agreed to an extension, adding, “I want my case heard by a Los Angeles Superior Court judge.”

In March, Lutfi filed papers objecting to the California Superior Court commissioner who ordered him to stay away from the singer.

Lutfi is free to appear in court on April 16 to petition for a new judge.

In February, a restraining order was issued against him after Lynne Spears accused him of drugging her daughter.

Sam Lutfi filed papers objecting to Superior Court Commissioner Reva Goetz's assignment to Britney Spears' conservatorship case on Friday, according to the AP (via OMG!).

According to the report, Lutfi filed the papers on Friday but was too late for them to reach the courtroom in time to affect Monday's hearing. The documents indicate that Lutfi is representing himself in this matter. On Monday, Sam agreed to the extension of the restraining order against him but this filing relates to the conservatorship granted to Brit's dad Jamie.

Sam and his spokesperson Michael Sands, have been making their case to the media that Goetz has a conflict of interest in the case and, they claim, because she did not graduate from an accredited law school.

We'll see how this pans out ... seems Sam's not going down without a fight!

Brit to Sam -- Have a Bitchin' Spring

TMZ has learned Sam Lutfi has agreed to back off the Brit for another 30 days.

We've learned Lutfi and the conservators have avoided the court showdown tomorrow by agreeing to extend the restraining order against Lutfi for 30 days. Under the existing order, which expires tomorrow, Lutfi must stay 2 1/2 football fields away from the Britster and basically have no contact with her at all. The parties have agreed to extend that order.

The Commish will sign off on the extension at the hearing tomorrow.

Sources tell TMZ there was a meeting between Lutfi and the conservators last week. Lutfi had been locked and loaded to fight any extension -- so it appears something that happened during that meeting changed his mind.

We're told Lutfi believes the restraining order extension is a good thing for both him and Brit.

Sam Lutfi's spokesperson, Michael Sands, is set to be deposed tomorrow -- not as a representative of Sam but as the former spokesperson for Kevin Federline's attorney Mark Vincent Kaplan. He's being put under oath in connection with KFed's custody suit.

Brit's former attorneys Trope & Trope subpoenaed Sands in hopes of getting some dirt on Kaplan and some inside scoop on the way Kevin's custody case is being run. And it looks like they'll get it! (Attorney Stacy Phillips will be handling the case now.)

Sands says he's privy to LOTS of juicy details; he told X17online exclusive, the following:

"I'll have to reveal the name of the person who told me Sam Lufti was a drug dealer and that I should plant that he was a drug dealer in the media. There were two people who witnessed this and I'll have to say who they are...

"I'll also have to reveal the name of the person who told me, after I'd been subpoenaed -- I'd already picked up the subpoena from my post office box -- to actually take the subpoena back to the post office and put it back in the box. I was told to pretend I'd never got it."

We've been hearing rumblings for a good week now that something EXPLOSIVE is going to happen in the Britney conservatorship/Sam Lutfi restraining order legal mess.

Sam's spokesman Michael Sands -- who also happens to be the spokesman for the attorney Britney apparently retained, John Eardley -- quotes Eardley as saying:

"I have uncovered explosive evidence that will shock the world. If so much as a hair on Britney Spears' head is harmed, I will hold everyone who has anything to do with Britney, personally liable and the people involved will be prosecuted to the full extent of the law. I will leave no stone unturned!"

Meanwhile, News of the World reports that Britney will be the star witness in a hearing set for March 17 in which she and her attorney Eardley will try to overturn the restraining order obtained by her family, against Sam Lutfi.

The report says Britney will present evidence against her parents and that Sam will argue Britney is getting drugs from "other visitors" -- visitors other than whom, we're not sure. There have hardly been any visitors other than Britney's parents and Adnan.

Britney Spears is set for a court showdown with her parents as she tries to wrestle back control of her life.

The singer, 26, will be the star witness in a battle to overturn a restraining order taken out by her family against her former manager Sam Lutfi. Britney will be asked to give evidence against dad Jamie and mum Lynne, who currently have control of her assets after her recent breakdown.

Lutfi has been banned from going within 250 yards of Britney after her parents accused him of drugging her with prescription pills and cutting her phone lines. But he wants to clear his name and has secretly contacted the star via a third party to ask for her support. Lutfi told a pal, "I am going to call Britney to the stand so she can tell the world how I was helping her. I am innocent. I am Britney's friend and would never hurt her."

Lutfi is said to be preparing a dossier for the hearing at LA Superior Court on March 17 in which he'll claim Britney had access to drugs from other visitors and fears her life is being taken over. The star was discharged from a psychiatric ward last month and is believed to be back at home in LA.

So here's what went down at the courthouse today with the hearing regarding Sam Lutfi's restraining order:

Bottom line: at 6pm yesterday, a federal judge agreed that the case be moved to district court. Therefore, Commissioner Goetz today couldn't rule on any thing until the case, if the case, gets remanded/sent back to state court.

However, despite Lutfi not being served by the Wednesday deadline, the restraining order is valid because Jamie Spears went to federal court yesterday and was granted an extension of restraining order until March 17, and therefore lutfi was served in time for that March 17 deadline.

On February 25, the federal judge will review arguments from both Jamie Spears and Jon Eardley to decide if Eardly showed good cause to keep the case with the federal court. Jamie will argue that because Britney was found "to lack the capacity to retain counsel on February 6," Eardley can't legally say he's Britney's lawyer.

Meanwhile Commissioner Goetz said: "We are in a holding pattern until the district court decides which jurisdiction should continue with the case."

It's now been confirmed that a hearing has been scheduled to discuss the validity of the restraining order served to Sam Thursday, as we reported yesterday.

It's unclear whether or not the order, which was served after the deadline had passed, is legal or not.

We spoke with Sam's attorney just moments ago, and this is what he told us:

"I’ve represented Sam in connection with the deposition that was marital dissolution. He was deposed by Mark Kaplan who represents Kevin.

If [the restraining order service yesterday] is not valid, they would have to reissue and set new dates. It had to have been served at least 48 hours before the hearing. Any hearing that is scheduled cannot proceed because of lack of notice. I would expect there would have to evidentiary hearing set with both sides represented which couldn’t happen today. I would expect they will reschedule the hearing today."

However, the court spokesperson, Allan Parachini, released this statement last night:

UPDATE:

TMZ has learned Brit's BFF, Sam Lutfi, has finally been served with a restraining order from her parents -- sorta.

As we reported earlier, the restraining order had to be served by yesterday at 1:30 PM to be valid. We're told that since it wasn't served until today, it may not be valid! That means they may have to serve him again with updated paperwork.

We hear Sam was finally found at his house in West L.A., today at around 11:00 AM PT as he walked out the door.

The Federal judge in the Britney Spears conservatorship saga has issued an order extending the restraining order against Sam Lutfi.

LOL, no one has a clue about anything in Hollywood.

Is Sam Lutfi being investigated by the LAPD Major Crimes Division, Robbery Homicide Division, or any other division of the LAPD for allegedly drugging Britney Spears? NO!

TMZ's report today and their Feb 15th report in which they cite "law enforcement sources," are not true, according the the LAPD.

Tyler Gray at Radaronline, picked up the phone and called the LAPD to clarify TMZ's initial report only to find out the whole thing was wrong!

And now we just picked up the phone to do the same and guess what -- LAPD spokesperson Richard French told us the same thing -- Sam Lutfi is NOT being investigated by any division of the the LAPD for anything.

French added that any LAPD employee giving information to the media that could compromise an investigation would certainly be at risk of losing his/her job. That said, it sounds like TMZ sources didn't break any rules -- unless punking a website is a crime!

Meanwhile, Sam's publicist Michael Sands wants to media to stop punking his client and focus on Britney's father Jamie. He posed this challenge to Mr. Spears in a phone conversation with us today:

Law enforcement sources tell TMZ the LAPD investigation into Sam Lutfi allegedly drugging Britney Spears is well underway.

We're told the case has now been assigned to Robbery Homicide, primarily because of the sensitive nature of the allegations and the intense media interest in Britney Spears. Sources say investigators have interviewed several witnesses regarding the drugs in Brit's system at the time she was most recently committed.

We're told the investigation had been temporarily derailed because of the death of an LAPD SWAT officer but it's now back on track.

One source says the investigation will probably be concluded in late March.

According to OK!, Sam is accused of grinding up Risperdal and Seroquel in order to drug Britney. Both drugs are antipsychotic medications, one for bi-polar and the other for schizophrenia.

These are not the usual slip your boss a mickey type of drugs. These are for mental disorders. They also have some crappy side effects from a "disfiguring" disease to "thoughts about suicide".

Why even ask who the doctor is who prescribed the pills? WTF cares right? It's only matter who physically handed her them... Why even ask what the side effects of those pills are. It doesn't matter.

Nope, it doesn't matter that even an anti smoking pill causes psychotic episodes. Yeah that's right... Chantix, the new Pfizer drug meant to assist smokers in the process of quitting caused Carter Albrecht, a Dallas musician, to flip out and get himself killed back in Sept.

Don't believe it? Pfizer, itself, strengthed warnings in Jan that Chantix may cause "depression and suicidal behavior".

If an anti-smoking drug can do that... what else can these new prescription drugs cause? Perhaps psychotic tendencies from our fave pop star.

He went on to say that Sam has not escaped to Dubai, has no intentions of suing Lynne Spears for defamation, and perhaps most importantly, "never demanded cash" from Brit's business manager (at least for now), Howard Grossman.

"Sam was inserted into Britney's life in October," by whom, Sands would not say, "after Britney had already shaved her head and been in two drug rehabs. Sam became her manager, and then her close friend. A manager does get paid." Sands went on to insist that Sam never asked, much less insisted, on being paid more than he deserved as someone in Brit's employ.

We went to Area in LA on Saturday night to celebrate Paris' birthday with her, and who was also there????

None other than Osama Lutfi and Alli Sims.

Even that crazy Scandinavian guy was there!

ALL of Britney's old crew showed up. And it was so bizarre.

We've called Osama shady about a million times and he was all smiles, trying to be our best friend.

Alli was all smiles too and laughing at every time we've drawn our little "love dots" on her pictures. So bizarre.

And the Scandinavian dude invited us to some SWAG event he's throwing. Not so bizarre. We love free shit!

Sims also told us that things are also tense between her and Britney's family. Though she denied a rift, she told us that "[Jamie & Lynne] are being very strict right now."

By that she means that she hasn't seen Brit Brit in a while or isn't allowed to see her.

"Kevin Federline needs to get on TV and say, 'I'm learning about Britney's bipolar disorder. He needs to step up to the plate and not hide behind the shield of his lawyer and be a man. He could become a hero instead of hiding.

He's the better parent, and he has the right to his own life. He's divorced, and if he's smoked pot, as reports have said, so be it. The kids are safe with him. But he's got to step up and help Britney. Don't hide behind your lawyer. He needs to learn and speak out so he can help his kids as they get older. People will become ultra sympathetic towards Britney as they learn about this illness.

Britney needs to be in a hospital for a year. She needs to see her kids. She needs to be in a nice atmosphere. This is overkill, it made my stomach turn. Every time we had to go into court, yes we have to protect the kids. But every mother, healthy or unhealthy should see their kids. In Britney's case, her parents need to let Sam Lutfi in her life and drop this. You can't blame someone for mental illness. Mark Vincent Kaplan needs to lay off. Everyone has to lay off! Before Britney dies accidentally.

A source on the inside the LA County Police Department has told me that the police captain is deeply concerned with the deposition made by Lynne Spears about Sam Lutfi and they are looking to possibly press charges.

This means in the next couple of days Lutfi could face possible jail time for admitting he had drugged and manipulated Britney Spears.

I just made a call to Michael Sands, Lutfi's new publicist who said he would 'look into the situation and ring me back within an hour.'
